By accessing or using Aqta's AI governance platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you (either an individual or an entity, "Customer", "you", or "your") and Aqta Technologies Ltd, a company registered in Ireland with company number 807530 ("we", "us", or "our").

The Service acts as a gateway between your applications and AI providers. We process metadata only and do not store full prompts or responses.
To use the Service, you must:
You are responsible for all activities that occur under your account.
We offer multiple subscription tiers (Starter, Pro, Healthcare, Enterprise) with different features and usage limits. Current pricing is available at aqta.ai/pricing.
Subscriptions are billed monthly in advance. By subscribing, you authorise Aqta to charge your payment method according to the terms until you cancel.
If you exceed your plan's included requests, overage charges apply at €0.0001 per additional request. You will be notified when approaching your limit.
Subscription fees are non-refundable except as required by law or at our sole discretion.

For AI traffic processed through Aqta, you remain the data controller and we act as your data processor under GDPR. Our data processing practices are detailed in our Privacy Policy and Data Processing Agreement (DPA).
You represent and warrant that you have all necessary rights and consents to process data through the Service and that you comply with all applicable data protection laws.
The Service, including all software, content, and trademarks, is owned by Aqta and protected by intellectual property laws. These Terms do not grant you any ownership rights to the Service.
You retain all rights to your data and content. By using the Service, you grant us a limited licence to process your data solely to provide the Service.
Aqta maintains a proprietary database of anonymised loop patterns derived from aggregated usage across our customer base. This shared intelligence enables faster loop detection for all customers whilst maintaining strict privacy protections.
We store cryptographic hashes (SHA-256) of loop pattern metadata, including:
We never store: Actual prompts, responses, user identifiers, or any content that could reveal proprietary information or identify specific customers.
The hashing process is one-way and cryptographically secure. Even with access to our database, it is mathematically impossible to reverse-engineer the original prompts or identify specific customers. Only aggregated, anonymised metadata is retained.
This approach is similar to privacy-preserving systems used by Google Safe Browsing, Apple's CSAM detection, and Cloudflare's threat intelligence—all of which share hashed patterns without exposing underlying content.
When we detect a loop pattern for one customer, all customers benefit from faster detection—typically 3x faster—without any data sharing. This creates a network effect where the product improves as more customers use it, whilst maintaining zero-knowledge privacy.
You retain full ownership of your data and prompts. The pattern database and associated algorithms remain Aqta's confidential trade secrets. By using the Service, you contribute to this shared intelligence whilst benefiting from collective protection against loop patterns.
Opt-Out: Enterprise customers may request to opt out of pattern sharing by contacting support@aqta.ai. Note that opting out may reduce the effectiveness of loop detection for your account.
This system is designed to comply with GDPR Article 5 (data minimisation), AI Act Articles 12 and 14 (transparency and human oversight), and HIPAA (no PHI stored). Technical documentation is available upon request for compliance review.
We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control.
Enterprise customers may have specific Service Level Agreements (SLAs) as outlined in their contracts.
To the maximum extent permitted by law:
Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
We may suspend or terminate your access if you violate these Terms or for non-payment. Upon termination, your data will be deleted according to our retention policies.
We may modify these Terms at any time. Material changes will be notified via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
These Terms are governed by the laws of Ireland. Any disputes shall be resolved in the courts of Ireland.
